WHY A PROFESSIONAL PROTECTOR?
The appointment of a suitable Protector is becoming increasingly important as the application of trusts evolves.
The Protector role carries importance not always fully reflected in the person(s) chosen by the Settlor to perform this function.
It is usually a close family friend or associates the chosen to fulfil the role, and in many cases, their knowledge of trusts and related matters is limited, if any.
With increasingly complex trust laws and new reporting obligations, it is imperative to have a Protector that has a legal background and experience on trust matters.
We independently oversee and monitor the management of the Trust to assure that it is administered in accordance with the Settlor’s wishes.
We provide the required professional skills, depth of knowledge, and experience while ensuring a personal and professional service on a long term basis.
Benefits of the selection of a Professional Protector are:
• Independence
• Professional skills
• Experience
• Succession
We work with the Settlor, their advisors, and the Trustee, to achieve the foreseen goals.
Our skills and knowledge on the subject, together with more than 20 years’ experience in legal and investment matters, makes us ideal for this key role.
What set us apart is our close relationship with our clients.
PROTECTOR SERVICES
Protector’s powers are primarily derived from the trust document.
Depending on the Settlor’s views, the trust deed can confer a wide variety of powers on the Protector, which can be either positive (compelling the Trustees to do something), or negative (prohibiting the Trustees from doing something unless the Protector consents).
Examples of the above powers include:
1. remove and appoint Trustees;
2. approve a change of law;
3. approve the addition or removal of beneficiaries;
4. approve proposed trust distributions;
5. approve the appointment of an adviser;
6. approve investment recommendations; and
7. terminate the trust or approve the termination of the trust.
